Terms of use for the API Service

Any Internet user who meets the requirements of these Terms of Use for the API Service and has accepted them may use the API service available on the website http://hh.uz (hereinafter referred to as the “Website”) for the functioning of their Application (as defined below) (hereinafter referred to as the “Application Developer”)

The Owner of the Service is LLC “HEADHUNTER CIS”, TIN 313 090 483 (hereinafter referred to as “HeadHunter”).

Use of the Service means the Application Developer’s consent to the terms and conditions set forth below (hereinafter referred to as the “Terms”).

1. Procedure for starting the use of the Service

1.1. To start using the Service, the Application Developer must, using their account credentials on the Website, complete the registration procedure on the Website at https://dev.hh.uz for the software program that will subsequently interact with the Service at the software level, including through the use of the API (hereinafter referred to as the “Application”) and obtain a unique API key.

1.2. If, at the time of registering the Application on the Website (clause 1.1.), the Application Developer does not have their own account information on the Website, they must also obtain it at the following addresses: http://hh.uz/auth/applicant (for job seekers) or http://hh.uz/auth/employer (for employers, recruitment agencies, and private recruiters).

1.3. Should there be grounds specified in clauses 1.6., 2.3., and Sections 3, 4 of the Terms, HeadHunter has the right to refuse any Application Developer registration of any of their Applications on the Website, obtaining an API key and, accordingly, further use of the Service without any compensation or reimbursement in connection therewith.

1.4. If the Application is fully or partially targeted at individuals using the Application for the purposes of job searching and employment, the Application Developer is obliged to include in the registration form for new users of their Application that will utilize the Service, a checkbox or text field informing the end user of the Application that by registering, they thereby confirm they have read, fully agree with, and accept the terms of the “Agreement on the provision of employment assistance services (offer)”. Furthermore, end users of such an Application must be provided with the technical capability to read the text of the “Agreement on the provision of employment assistance services (offer)” directly on the screen of the respective device on which such an Application is installed. Its text must be displayed when clicking on a link with the following signature (text): “Agreement on the provision of employment assistance services (offer)”. The address of the aforementioned link to the text of the “Agreement on the provision of employment assistance services (offer)” is https://hh.uz/account/agreement.

1.5. End users of the Application may be legal entities and individuals who act as either employers or organizations providing services for the search and selection of personnel and/or for job searching and employment (recruitment agencies), as well as job seekers. If the end users of the Application are organizations and individuals acting as employers or recruitment agencies, these persons have the right to use the Service solely for the purposes of attracting potential employees and their subsequent employment directly within such legal entities (by such individuals) or with the clients of such recruitment agencies.

1.6. If HeadHunter has reason to believe that the Service could potentially be used by the Application Developer or an end user of the Application for purposes other than attracting potential employees and their subsequent employment (for example, assessing a job seeker’s solvency and credit rating, conducting marketing surveys regarding job seekers’ consumer preferences, promoting advertising and advertising mailings without the recipients’ consent, and other instances of data usage unrelated to attracting potential employees and employing job seekers), HeadHunter has the right at any time (including during the Application registration stage) to deny the Application Developer the use of the Service without any compensation or reimbursement in connection therewith. The determination of the Application’s actual capabilities and its actual intended use, which would allow it to be utilized by the Application Developer or end users of the Application for purposes beyond attracting potential employees and their subsequent employment, is conducted by HeadHunter both at the time of reviewing the Developer’s respective application for the registration of the Application and subsequently after such an Application has been registered and a unique API key has been obtained. This determination of the Application’s actual capabilities and its actual intended use is based on information provided by the Application Developer themselves, public information available on the Internet, other sources of information about such an application and the experience of its use by end users, as well as the results of HeadHunter’s independent testing of such an Application.

1.6.1. Examples of how an Application Developer or end user of the Service Application may use the Application for the purposes of attracting potential and their subsequent employment may include the following functional capabilities or intended use by end users: publishing vacancies, inviting a job seeker to a published vacancy, searching the resume database of job seekers for subsequent contact with the aim of employing the job seeker for a published vacancy, and similar actions directed at attracting potential employees and employing job seekers.

1.7. If there are grounds specified in clauses 1.6., 2.3., and Sections 3, 4 of the Terms, HeadHunter shall notify the Application Developer by email regarding the refusal to register any of their Applications on the Website, issue an API key, and allow the further use of the Service, indicating the specific violations and breached clauses and clarifying the procedure for appealing this decision.

1.8. In the event of a refusal to register any Application on the Website, issue an API key, and, consequently, allow the further use of the Service, the Application Developer may appeal this decision by submitting a corresponding secondary electronic application for Application registration on the special page https://dev.hh.uz/admin, attaching justifications and/or evidence that the decision was erroneous. Applications are reviewed on an individual basis, but the total response time may not exceed 15 calendar days.

2. Rights and obligations of HeadHunter

2.1. The Service is provided “AS IS” without any warranties from HeadHunter.

2.2. HeadHunter does not guarantee that the software of the Service, the Website, the server, and the computer networks used by the server and the Website are free from errors and computer viruses. If the use of the Service results in data loss or equipment damage, HeadHunter shall not be held liable for it.

2.3. In case of violation by the Application Developer, including a violation of the Application Developer’s obligations with respect to the Application itself, of the requirements of clauses 1.4., 1.5., 1.6., and Sections 3, 4 of these Terms, HeadHunter has the right at any time, by sending an email notification to the Application Developer specifying the particular violations committed, the breached provisions of clauses 1.4., 1.5., 1.6., and Sections 3, 4 of these Terms, and containing a hyperlink to these Terms, to suspend the Application Developer’s ability to use the Service in whole or in part, as well as the validity of the unique API key provided upon registration of the relevant Application. Following such a suspension, the Application Developer is granted a period of 15 calendar days from the moment of suspension to eliminate the detected violations. If such violations are eliminated within the specified period, the Application Developer informs HeadHunter about this in the manner specified below, and the operation of the Application or its individual functions, as well as the validity of the unique API key, shall be restored after HeadHunter verifies the accuracy of the corrections made by the Application Developer (the verification period may not exceed 15 calendar days).

If the Developer fails to rectify the violations within the specified period of time or the information provided by the Application Developer regarding the rectification of the violations is not confirmed during HeadHunter’s verification, the possibility of using the entire Service by the Application Developer or its individual functions, and the validity of the unique API key provided upon registration of the respective Application, will be terminated.

The Application Developer may appeal the decision to suspend and the decision to terminate the use of the entire Service by the Application Developer or its individual functions, as well as the validity of the unique API key provided upon registration of the respective Application, by submitting a corresponding secondary electronic application for Application registration on the special page https://dev.hh.uz/admin, attaching justifications and/or evidence of the error in this decision. Applications are reviewed on an individual basis, but the total response time may not exceed 15 calendar days.

2.4. HeadHunter reserves the right to make changes to the Service (its functionality, technical terms and usage requirements, interface, etc.) at any time, at its own discretion and without notifying the Application Developer.

2.5. HeadHunter reserves the right at any time, at its own discretion, to introduce a fee for accessing certain features of the Service.

2.6. The possibility of obtaining certain functions of the Service may be restricted by HeadHunter. The rules and procedures for obtaining the ability to use such specific API functionality are determined by HeadHunter. HeadHunter has the right to deny any Application Developer and/or any Application the use of certain API functionality to which access (availability) is restricted by HeadHunter. If restrictions are imposed on the ability to access a specific Service functionality, HeadHunter will notify the Application Developer via email about such restriction and the reasons for which the restrictions were introduced. If the restriction on obtaining a specific functionality is not related to HeadHunter terminating its support for all application developers, the Application Developer may appeal this decision by submitting a corresponding electronic application on the special page https://dev.hh.uz/admin, attaching justifications and/or evidence that the decision was erroneous. Applications are reviewed on an individual basis, but the total response time may not exceed 15 calendar days.

2.7. HeadHunter reserves the right to independently establish the technical requirements for the Application Developer’s ability to use the Service.

2.8. Notifications, messages, and other information sent under these Terms by HeadHunter to the Application Developer shall be sent to the email address of the user who registered the Application. The Application Developer is responsible for keeping the information about email address of the user who registered the Application up to date.

3. Rights and obligations of the Application Developer

3.1. The Application Developer is responsible for the use, security, and confidentiality of the unique API key they have received.

3.2. The Application Developer shall not use the Service in ways that violate the rights and legitimate interests of HeadHunter and third parties, legislation on personal data, any other legislation, as well as the requirements of the Terms.

3.3. The use of any materials obtained via the Service from the Website is prohibited for any purposes other than those related to the Website’s subject matter (job searching, employee searching, obtaining labor market information).

3.4. The Application Developer is not permitted to use HeadHunter’s trademarks and corporate name within the Application(s).

3.5. The Application Developer is prohibited from disguising the Application(s) as any applications belonging to HeadHunter or from misleading end users of the Application in any other way regarding the developer or owner (copyright holder) of the Application.

3.6. The Application Developer is prohibited from collecting, storing, or in any other manner processing the account information (logins and passwords) of the Website users, including doing so through the Service or the Application.

3.7. The Application Developer is not permitted to use the API functionality to provide access to resumes from the Website’s database to end users of the Website who, at the relevant time, do not receive from HeadHunter, under a relevant agreement concluded with HeadHunter, a service providing access to the Website’s resume database in the relevant scope.

3.8. The Application Developer has the right to use the Application for their own (personal) needs, provided that such use does not violate or contradict the Terms and legislation.

3.9. In the case of disagreement with a refusal to register their Application and issue them a unique API key, the Application Developer has the right to reapply for the registration of such an Application by eliminating the causes that, according to the Terms, served as the grounds for the refusal to register their Application and issue them a unique API key.

3.10. The Application Developer is prohibited from disseminating false information about the Application or misleading users regarding the Application’s functional capabilities, such as promising anything that violates the terms of use of the Website http://hh.uz.

3.11. The Application Developer is prohibited from making any changes to the materials obtained via the Service from the Website. The Application Developer is obliged to monitor the relevance of the materials, including the timely removal of vacancies that have been moved to the archive.

4. Obligations of the Application Developer regarding the Application itself

4.1. The Application must not contain functions that enable Application users to violate the Terms of Use of the Website http://hh.uz, which are publicly available at http://hh.uz/terms.

4.2. The Application must not be presented as an official product, service, or application of LLC “HEADHUNTER CIS”.

4.3. The Application shall not allow downloading (receiving, extracting) data to form another database for the purpose of providing data from such a created database (access to the database) to other persons.

4.4. The Application must not contain third-party libraries or code fragments that are not directly related to its functionality, including those that exploit the computing power of the user’s device without their knowledge.

4.5. It is prohibited to store and use data obtained through the Application for purposes other than those corresponding to the subject matter of the Website https://hh.uz, namely contact between a potential employer and a potential job seeker for the purpose of subsequent employment.

4.6. It is prohibited to transfer data obtained via the Service from databases and Websites owned by HeadHunter and used for the Service’s operation to third-party services for use. The only users of the data obtained via the Application may be registered users of the Website http://hh.uz for whom the data retrieval was initiated. This provision does not apply to the transfer (use) of other data; in particular, this clause does not prevent the Application from participating in public ratings by providing data on the number of downloads of the Application by end users, the frequency of use, or the number of end users of the Application, as well as other ratings indicating the popularity of the Application among end users.

4.7. It is prohibited to use user data for advertising purposes without the recipients’ consent, including in the form of spam mailing, or for the purposes of political or other agitation.

4.8. It is prohibited to violate the rights and interests of third parties when creating and using the Application. If the Application uses any trademarks, service marks, copyrights, characters, or any other content over which exclusive rights belong to third-party copyright holders, such use must be authorized by the relevant rights holders — so that, upon a request from HeadHunter, the Application Developer may at any time provide the authorization to use such materials from the relevant right holders.

4.9. The Application must not trigger any active actions in the API without the knowledge and consent of the users being authorized.

4.10. These Terms do not prohibit placing advertising units or displaying advertisements within the Application itself for the purpose of showing them to end users, provided that the requirements of advertising legislation are complied with.

5. Other terms and conditions

5.1. HeadHunter reserves the right to change the Terms at any time, at its own discretion and without coordination with the Application Developer. In such a case, the changes and additions come into effect from the moment they are published on the Website.

5.2. The use of the Service by the Application Developer, as well as exercise by the Application Developer of rights and performance of the obligations established by these Terms, after any changes to these Terms constitutes the Application Developer’s acceptance of such changes and/or additions.

5.3. If the Application Developer does not agree to use the Service after changes have been made to the Terms and/or to comply with the Terms after the changes, the Application Developer is obligated to cease using the Service.

5.4. The Terms, as well as the relationship between the Application Developer and HeadHunter, including matters not explicitly governed by the Terms, shall be regulated in accordance with the legislation of the Republic of Uzbekistan.

5.5. All disputes and disagreements arising between the Application Developer and HeadHunter must be resolved through negotiations.

5.6. If it is impossible to resolve disputes between the Application Developer and HeadHunter through negotiations, they shall be resolved in court at HeadHunter’s place of state registration in accordance with the procedure established by the procedural legislation of the Republic of Uzbekistan. Disputes under these Terms may be submitted to the court after the parties have taken pre-trial settlement measures upon the expiry of 30 calendar days from the date of sending the claim (demand).
